Rental Terms and Conditions

These terms and conditions apply to individuals who are hiring out or renting a camping vehicle through Just Kampers Hire’s Website. By creating an Account with Just Kampers Hire you are accepting these terms and conditions and they become legally binding.

We have divided these terms and conditions into sections for ease of reference but please ensure that you read these terms carefully as a whole so you are aware of the obligations you owe to others, and the obligations others owe to you.

Definitions:

Account

The profile created when registering on the App or Website hire/rent a Rental.

App

The Just Kampers Hire device application to provide the Website and manage Bookings for the Rental.

Booking

A reservation made by the Customer through the Website to use a Rental for the Rental Period subject to the Rental Agreement.

Booking Fee

The fee percentage charged by Just Kampers Hire as set out in the Booking Summary as part of the Total Price.

Booking Summary

An overview of the details of the reservation to hire the Rental through the Website. This shall include any revisions to the reservation mutually agreed by the Customer and Owner.

Breakdown

A mechanical fault with the Rental not caused by an accident, or any misuse of the Rental (or any equipment) by the Customer.

Breakdown Provider

The provider of a roadside assistance or breakdown cover under a policy 7arranged through the Owner or Just Kampers Hire.

Camping Vehicle

A motorhome, a van, a mobile home, caravan, camper trailer, trailer tent or any other vehicle that is suitable for overnight accommodation.

COVID-19

The coronavirus disease or severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2).

Customer

An individual that uses the Website to hire a Rental from the Owner according to the Rental Agreement.

Damage

Any damage caused to the Rental, howsoever arising, during the Rental Period more specifically described here.

Departure Date

The first day the Rental Period is due to commence.

Driver

The individual (when differing from the Customer) who has been notified and approved by the Owner to drive the Rental during the Rental Period.

Excess

The amount per incident that the Customer is liable for in case of Breakdown or Damage. The amount shall be stated as part of the Booking Summary.

Force Majeure Event

Any circumstance not within a party’s reasonable control including, without limitation: acts of God, flood, drought, earthquake or other natural disaster; epidemic or pandemic (excluding COVID-19); terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations; nuclear, chemical or biological contamination or sonic boom; any law or any action taken by a government or public authority, including imposing an export or import restriction or failing to grant a necessary licence or consent; collapse of buildings, fire, explosion or accident; any labour or trade dispute, strikes, industrial action or lockouts; non-performance by third parties and interruption or failure of utility service.

Intellectual Property Rights

Patents, rights to inventions, copyright and neighbouring and related rights, moral rights, trademarks and service marks, business names and domain names, rights in get-up and trade dress, goodwill and the right to sue for passing off or unfair competition, rights in designs, database rights, rights to use, and protect the confidentiality of, confidential information (including know-how and trade secrets) and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world.

Inventory

A list of all of the accessories and items in the Rental at the beginning of the Rental Period, together with the general condition and details of any pre-existing damage to the exterior and interior of the Rental.

Just Kampers Hire

Just Kampers Hire Hire Limited registered in England and Wales under company number 13026802 whose registered office is Unit 1 Stapeley Manor, Long Lane, Odiham, Hampshire, United Kingdom, RG29 1JE.

Just Kampers Hire’s Insurer

The insurance company providing motor insurance for the Rental, arranged by Just Kampers Hire.

Just Kampers Hire’s Insurance

The motor insurance for the Rental arranged by Just Kampers Hire’s Insurer.

Liability Deposit

An amount per Rental specified in the Booking Summary to be paid by the Customer against which any expenses incurred during the Rental Period may be set-off against in accordance with these Terms.

Listing

The advertisement for the Rental published and managed on the Website by the Owner.

Owner

The individual who is registered as the legal owner, or is authorised by the legal owner, to rent the Rental through the Website in accordance with the Rental Agreement.

Owner’s Insurer

The insurance company providing motor insurance for the Rental, arranged by the Owner.

Owner’s Insurance

The motor insurance for the Rental arranged by the Owner’s Insurer.

Rebooking Cost(s)

The extra costs incurred by Customers having to rent an alternative Camping Vehicle through the Website following cancellation by the Owner.

Rent

The price for the use of the Rental during the Rental Period as set by the Owner.

Rental

The Owner’s Camping Vehicle that is hired by the Customer.

Rental Agreement

The terms on which the Customer and the Owner rent/hire the Rental comprising of these Terms and the Booking Summary.

Rental Period

The length of time the Customer has hired the Rental as set out in the Booking Summary, including any agreed extension in accordance with clause 17.2.

Repair Cost(s)

The costs that are incurred in order to return the Rental to the same condition as prior to the Breakdown or upon sustaining of any Damage. Proof of such costs shall be provided, including but not limited to, purchase receipts for replacement parts and materials as well as repair invoices that meet the local legal requirements for tax receipts. Labour costs can be included as repair costs provided they have also been specified in an invoice meeting local legal specifications and said invoice is issued by a company registered with the Chambers of Commerce.

Terms

These terms and conditions including the annexed appendices.

Total Price

The total fee payable by the Customer including: transaction costs; hand-over costs; motor insurance and breakdown policy costs for the Rental; the Excess; the Rent; Liability Deposit and the Service Charge.

VAT

Value added tax or any equivalent tax applicable in the country of hire.

Verification

Identity verification and/or vehicle verification carried out by Just Kampers Hire and/or the Just Kampers Hire’s Insurer.

Website

The platform that is accessible through the App and the Just Kampers Hire’s website: www.justkampershire.com that offer Customers and Owners the opportunity to hire and /or rent a Rental.

  1. General
  • Just Kampers Hire reserves the right to make changes to these Terms and/or the Website. Any changes will be announced by e-mail or by notification on the Website, Just Kampers Hire will do its best to provide reasonable notice of any changes. Continuance use of the Website and any Booking will be regarded as acceptance of any new terms. These Terms were last updated on 9th March 2021.
  • Just Kampers Hire is the operator of the Website which is an online marketplace providing Owners with the ability to create Listings advertising the Rental for hire to Customers. The Owner is responsible for the acceptance of any Bookings. Just Kampers Hire is not an employee, agent, joint venturer or partner of the Owner.
  • By creating an Account with Just Kampers Hire you are warranting that you are at least 18 years of age. Just Kampers Hire will not facilitate any hire/rental by minors.
  • The Customer or Driver (as applicable) warrant they meet the physical and mental requirements of being able to safely drive the Rental.
  • The Customer or Driver must be at least 23 years of age and hold a full driving licence permitting them to drive the Rental. The Customer or Driver may only be permitted to drive the Rental once Verification has been completed and returns a positive result.
  • Verification of the Owner’s, Customer’s or Driver’s identity will be carried out by using an identity verification service requiring the respective driving licences. This service is provided by a third party company. The Owner will also be subject to Verification carried out through the relevant vehicle licensing authority of the jurisdiction of hire.
  • Just Kampers Hire reserve the right to carry out additional Verifications at any time. If the Verification returns a negative result requiring cancellation of the Rental Period, the Customer or Owner (as applicable) may be liable for the cancellation costs in accordance with clause 5 and Appendix B.
  • Unless it expressly states otherwise, the Rental Agreement does not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Rental Agreement.
  • The terms of the Rental Agreement are not intended to, or shall not be deemed to, establish any partnership or joint venture between any of the parties.
  • If any provision or part-provision of the Rental Agreement is, or becomes invalid, illegal or unenforceable, it will be considered deleted, but that will not affect the validity and enforceability of the Rental Agreement. If any provision or part-provision of the Rental Agreement s is deleted under this clause 10 the parties shall negotiate in good faith to agree a replacement that, to the greatest extent possible, achieves the result originally intended.
  • If there is an inconsistency between the Listing and the Rental Agreement the provisions of the Rental Agreement shall prevail.
  • Clause, Appendices and paragraph headings shall not affect the interpretation of the Terms. The Appendices form part of the agreement and shall have effect as if set out in full in the body of the Terms. Any reference to the Terms includes the Appendices.
  1. Booking Requests and Payment
  • Any Booking enquiry (Booking Request) must be submitted by the Customer through the Website. The Owner is requested to respond to a Booking Request within 24 hours. If the Owner accepts the Booking Request, the Customer shall be notified of the confirmation by Just Kampers Hire by e-mail and SMS (Booking Confirmation).
  • The Owner must not request, and the Customer must not, make any payments for the Booking outside of the Website.
  • The Customer shall make payment for the Booking in accordance with the below payment schedule:

Cancellation Policy

When Payment is Due

Flexible

No payment is required until 30 days before the Departure Date, when the Customer must make full payment of the Total Price.

Standard

£150 non-refundable deposit is taken at time of booking. Full payment is required at 6 weeks before the Departure Date, when the Customer must make full payment of the Total Price.

  • Just Kampers Hire shall issue a payment reminder to the Customer 14 days before the payment is due if the booking is made outside of the initial payment schedule.
  • If the Customer does not make payment in accordance with the table at clause 3, Just Kampers Hire reserve the right to cancel the Booking with immediate effect. The Rental shall not be released to the Customer on the Departure Date until payment of the Total Price has been received.
  • Just Kampers Hire may charge an administrative fee for issuing additional payment reminders which shall be payable by the Customer.
  • Details of the available payment methods are set out on the Website.
  • Just Kampers Hire shall deduct the Booking Fee before making payments due to the Owner. Any funds due to the Owner shall be issued by Just Kampers Hire 48 hours after collection of the vehicle by the Customer.
  • If any unforeseen charges or expenses are incurred during the Rental Period by the Customer that have not been accounted for in the Total Price (Additional Costs), the Owner may charge the Customer for the Additional Costs after the Rental Period has ended. Additional Costs include, but are not limited to:
  • loss of or Damage to the Rental as a result of the Customer failing to comply with the Rental Agreement;
  • Repair Costs;
  • additional Rent as in accordance with clauses 2 and 17.3;
  • the Excess payable per incident;
  • tolls, fines or traffic violation costs incurred by the Customer;
  • extra mileage beyond the scope agreed;
  • fuel costs if the Rental has not been returned with the same amount of fuel in the tank set out in the Inventory, plus a handling fee of £25.00;
  • cleaning costs of up to a maximum of £150.00, based on a rate of £10.00 per 15 minutes of work;
  • if it is evident that pets or smokers have been in the Rental which is not permitted by the Owner, the Owner may charge the Customer for professional cleaning costs; and
  • costs of replacing missing accessories or items as set out in the Inventory.

The Owner shall be required to provide evidence of any Additional Costs at the reasonable request of the Customer.

  • Just Kampers Hire may charge the Customer or Owner reasonable administration costs as set out in the Rental Agreement.
  • Unless stated otherwise, any payment due to Just Kampers Hire under the Rental Agreement must be settled in full within 14 days of issuing an invoice detailing such costs together with any VAT due. If any payment remains outstanding for 30 days from the date it is due, Just Kampers Hire reserves the right without notice to suspend the Owner’s or Customer’s Account and access to the Website and cancel any existing Bookings until payment is received in clear funds by Just Kampers Hire. Just Kampers Hire may set-off any overdue payment from the Liability Deposit (with priority over any Additional Costs), or from any funds due to the Owner.
  1. Breakdown and Roadside Assistance
  • The Owner or Just Kampers Hire shall provide Breakdown cover for the Rental for the duration of the Rental Period so the Customer or Driver may obtain roadside assistance in the event of a Breakdown.
  • The cost of the Breakdown cover shall be included in the Total Price.
  • The Owner or Just Kampers Hire (as applicable) shall provide the Customer with a copy of the Breakdown policy on or before the Departure Date. The Customer or Driver shall review and comply with all terms of the Breakdown policy.
  • The Customer must comply with the instructions of the Breakdown Provider.
  • The Customer must not carry out any act, omission or allow any act or omission to be carried out during the Rental Period that may invalidate or void the Breakdown cover. If the Customer does not comply with this clause 5, any Breakdown that would have otherwise been covered under the Breakdown cover shall be at the cost of the Customer.
  1. Inventory
  • The Inventory shall be provided digitally through the Website and shall be considered a reliable and accurate record of the contents and condition of the Rental. The Customer and Owner agree that the Inventory shall be relied upon should a dispute arise regarding the contents or condition of the Rental.
  • The Owner and the Customer can approve or object to the Inventory through the Website. An objection to the Inventory must include photographic images to substantiate the objection and must be made within 24 hours of the time set out in clause 4.3.1. If no objection is received within this time frame, the Inventory will automatically be approved. In the case of any hidden defects not reasonably visible upon the Customer’s initial inspection of the Rental, they must be reported to the Owner and Just Kampers Hire at the earliest possible opportunity but no later than 24 hours from the time the Rental is made available to the Customer for inspection on the Departure Date.
  • The Inventory shall include:
  • the time the Rental is made available to the Customer for inspection on the Departure Date;
  • the mileage on the Departure Date;
  • the agreed mileage limit that the Customer may travel;
  • a list of any pre-existing interior or exterior damage;
  • a note of the cleanliness of the Rental;
  • a list of the accessories and items included in the Rental; and
  • a note of the working order of the amenities.
  1. Cancellation of the Booking
  • The Customer may refuse the Rental in accordance with clauses 3 and 11.4, in these circumstances the Customer shall not be liable for any cancellation fees and shall be entitled to a full refund of the Total Price.
  • If the Customer cancels the Booking in accordance with clause 1, the Owner shall be liable for the administrative costs and losses incurred by Just Kampers Hire and costs set out in Appendix B.
  • If the Booking is cancelled by the Owner due to a Force Majeure Event the Customer shall receive a full refund of the Total Price and if possible, be offered an alternative camping vehicle for the Rental Period (which the Customer is not obliged to accept). The Owner shall not be liable for any cancellation fees, save for the administrative costs incurred by Just Kampers Hire. In the circumstance where the Force Majeure Event is not found to be accurate, the Owner shall be liable for the Rebooking Costs and the administrative costs and any losses incurred by Just Kampers Hire in accordance with Appendix B.
  • Just Kampers Hire may at its sole discretion, cancel a Booking affected by government restrictions on travel due to COVID-19 meaning the booking is unable to be fulfilled at time of travel. This does not cover disinclination to travel by the Customer. Just Kampers Hire will aim to notify the Customer and Owner 10 days prior to the Booking date, however government restrictions may come info affect after this time meaning this decision can be taken up to 24 hours prior to departure. Just Kampers Hire may issue:
  • a credit up to the value of the Total Price. Any credit issued under this clause 5.4.1 must be used towards a new booking with the same owner within 12 months of the scheduled Departure Date.
  • Subject to clauses 1 to 5.4, the terms set out in Appendix B shall apply to cancellations.
  1. Intellectual Property Rights
  • Just Kampers Hire or its licensors own and shall retain all Intellectual Property Rights that relate to the Website and the Rental Agreement.
  1. Account Termination
  • The Customer or Owner may delete their Account at any time provided that they are not a party to any live or scheduled Booking.
  • Just Kampers Hire may suspend, withdraw or delete a Customer’s or Owner’s Account for any breach of the terms of the Rental Agreement or misuse of the Website.
  1. Just Kampers Hire’s Liability
  • As the provider of the Website Just Kampers Hire does not own, create, sell, resell, provide, control, manage, offer, deliver, or supply any Rentals, nor is Just Kampers Hire an organiser or retailer of travel packages under Directive (EU) 2015/2302.
  • Owners are solely responsible for their Rentals and Just Kampers Hire does not provide any endorsement, guarantee or warranty in any aspect relating to: any Rental, Listing, or Booking, Website content provided by the Customer or Owner, the identification of the Customer or Owner. Any Bookings are arranged at the risk of the Customer and Owner in accordance with the Rental Agreement.
  • When Owners and Customers make or accept a Booking through the Website they are entering into a contract directly with each other. Just Kampers Hire acts as an intermediary and, is not and does not, become party to or other participant in any contractual relationship between the Owner and Customer.
  • Just Kampers Hire does not provide any guarantee or warranty in relation to the Verification, identity or background checks conducted on Customers or Owners and the results of such checks may only be relied upon at the risk of the Customer or Owner.
  • Just Kampers Hire may, at its sole discretion, assist in facilitating the resolution of any dispute resulting from a Damage claim between the Customer and the Owner. In assisting with any disputes, the Owner and Customer agrees to cooperate with and assist Just Kampers Hire in good faith, and to provide Just Kampers Hire with such information and take such actions as may be reasonably requested by Just Kampers Hire in connection with any Damage claim. The Customer and Owner agree that Just Kampers Hire may make a binding decision as to the amounts owed between the parties based on the information available to it at the time and the party at fault shall cover the reasonable costs incurred by Just Kampers Hire pursuant to this clause 5.
  • No terms under the Rental Agreement shall limit or exclude the liability of Just Kampers Hire, the Owner and/or the Customer:
  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • liability under indemnities;
  • any other matter in respect of which it would be unlawful to exclude or restrict liability.
  • In no circumstances shall Just Kampers Hire have any liability (including every kind of liability arising under or in connection with the Rental Agreement, including but not limited to liability in contract, tort (including negligence), misrepresentation, restitution or otherwise) for:
  • loss of profits;
  • loss of sales or business;
  • loss of agreements or contracts;
  • loss of anticipated savings;
  • loss of use or corruption of software, data or information;
  • loss of or damage to goodwill; or
  • indirect or consequential loss.

Subject to clause 8.5, Just Kampers Hire’s total liability under the Rental Agreement cannot exceed the Total Price.

  1. Governing Law and Jurisdiction
  • Subject to clause 2, the Rental Agreement and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of England and Wales. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Rental Agreement or its subject matter or formation.
  • If you are a consumer (a Customer that is a private individual) you may bring any judicial proceedings relating to the Rental Agreement before the competent court of your place of residence (if different to England and Wales). Just Kampers Hire may enforce any rights against you as a consumer, in the courts of your resident jurisdiction.

Owner’s Obligations

  1. Listings made through the Website
  • The Owner must ensure that any Rental included in a Listing complies with all applicable laws and regulations for driving on public roads.
  • Any Listing must accurately reflect and describe the Rental offered. Just Kampers Hire does not own and is not in control of any Listings. The Owner is solely responsible for any terms or content that it makes available in the Listing.
  • If the Rental no longer meets the requirements of clauses 1 and 10.2, the Owner must with immediate affect remove the Listing from the Website. If removal of a Rental results in the cancellation of any Booking, the Owner is liable for any cancellation costs as described in Appendix B.
  • The Owner represents and warrants that the content of a Listing will not infringe, misappropriate or violate a third party’s intellectual property rights or any applicable laws. If in the reasonable opinion of Just Kampers Hire any Owner’s content infringes any of these terms it reserves the right to remove such content without notice and may suspend or delete the Owner’s Account.
  • The Rent shall be set at the sole discretion of the Owner.
  • The Owner may not change the Rent once a Customer has been notified of the Total Price and has requested a Booking, unless the Customer’s requirements change.
  • The Owner must keep the Rental availability and Rent shown on the Website up to date at all times.
  • If a booking is arranged outside of the Website, Just Kampers Hire may without notice:
  • delete the Owner’s Account and withdraw their access to the Website;
  • remove any Listings or other content of the Owner from the Website; and
  • cancel any existing Bookings and seek any Rebooking Costs from the Owner.
  • Owners who operate any Rental as part of a business must ensure their company name or website is not visible on the Listing or any part of the Website without the written consent of Just Kampers Hire. A breach of this clause 9 may result in Just Kampers Hire taking any action set out in clauses 10.8.1 to 10.8.3.
  1. Rental Availability
  • The Owner must make the Rental available to the Customer at the location, time and date set out in the Booking Summary.
  • The interior and exterior of the Rental must be clean, and must include all items listed in the Inventory including being provided with a full fuel level. All accessories and amenities must be in satisfactory condition and properly functioning as indicated in the Listing.
  • If the Owner cannot make the Rental available, or cannot offer a like for like alternative to the Rental which satisfies the Customer, then the Customer may cancel the Booking according to clause 1.
  • If the Rental is substantially different to the description and images provided in the Listing the Customer may at their option:
    • request the Owner to fix or replace any non-functioning accessories and amenities;
    • request the Owner to provide an alternative Rental;
    • mutually agree a reasonable reduction of the Rent and notify Just Kampers Hire of the reduction as soon as possible; or
    • cancel the Booking in accordance with clause 1.
  • The Owner must provide the Customer with electronic or hard copies of the following documents:
    • a valid certificate of insurance for the Rental and copy of the insurance policy (where insurance is provided by the Owner’s Insurer);
    • a copy of the Breakdown cover arranged by the Owner;
    • instructions for driving the Rental and the proper use of the accessories and amenities; and
    • the Rental’s user manual (if available).
  • The Owner and Customer must agree any pre-existing defects and damage of the Rental on the Departure Date to be recorded in the Inventory in accordance with clause 4.
  • If the Owner arranges for a representative or third-party to facilitate the handover or return of the Rental, the Owner shall remain responsible for their compliance with the provisions of the Rental Agreement.
  • If the Owner’s Insurer requires any additional information or documents, it is the Owner’s sole responsibly to obtain these from the Customer prior to the Departure Date.
  • If the Owner permits the Rental to be taken to a foreign jurisdiction the Owner is responsible for providing the necessary equipment required for the Customer to comply with the legal regulations in the applicable country. For example, if the Rental is to be driven in France the Owner must provide the GB sticker, high visibility clothing and warning triangle.
  • The Customer must comply with the terms of any documents provided under clause 5.
  • The Owner is responsible for checking the Customer’s driving licence for identification purposes on the Departure Date before releasing the Rental to the Customer. The Owner reserves the right to refuse to release the Rental to the Customer if there are any discrepancies between the Customer’s driving licence and the Booking information. In this case, the Booking shall be immediately terminated without liability to the Owner. The Customer shall be liable for any cancellation fees in accordance with Appendix B. The Owner must contact Just Kampers Hire as soon as possible and notify them of any cancellation pursuant to this clause 11.
  1. Owner’s Insurance
  • The Owner may arrange and maintain the Owner’s Insurance to cover the duration of the Rental Period which must be provided by a reputable insurer regulated by the Prudential Regulatory Authority and the Financial Conduct Authority.
  • The cost for the Owner’s Insurance shall be included in the Total Price.
  • The Owner’s Insurance must:
  • be provided in accordance to all applicable laws and regulations;
  • be a comprehensive policy;
  • indemnify third parties for loss;
  • cover the Customer’s or Driver’s use of the Camping Vehicle as a Rental; and
  • be limited at no less than £6,000,000 per claim.
  • If the Owner operates as a business, the Owner must arrange and maintain their own public liability, and business liability insurance at all times.
  • The Owner shall provide a copy of the Owner’s Insurance policy to the Customer or Driver, and receipt of payment of the premium (if requested) to the Customer and/or Just Kampers Hire. The Customer and Driver shall review and comply with all terms of the Owner’s Insurance.
  1. Ownership and the Owner’s Liability
  • The Rental shall remain the Owner’s property.
  • The Rental shall be maintained regularly by the Owner, in accordance with the specifications of the manufacturer of the Rental and in accordance with Appendix A. The Owner shall keep up to date records of the maintenance.
  • The Owner shall provide evidence of the maintenance set out in clause 2 upon reasonable request by the Customer or Just Kampers Hire.
  • The Owner must ensure that a copy of the current MOT Certificate (if applicable), a current Gas Safety certificate by a Gas Safe Registered engineer and a fire extinguisher is available in the Rental.
  • The Owner is responsible for understanding and complying with all laws, rules, regulations and contracts with third parties that apply to letting the Rental.
  • The Owner shall remain solely responsible for fulfilling any legal obligations to report, charge and account for any VAT or other taxes in relation to any Rent or payments received in connection with the Listing and providing the Rental to the Customer.
  • The Owner shall indemnify all liabilities, costs, expenses, damages and losses (including any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs and all other reasonable professional costs and expenses) suffered or incurred by the Customer or Just Kampers Hire arising out of or in connection with any material breach of the Rental Agreement including the default of any VAT or other taxes due.

Customer’s Obligations

  1. Liability Deposit
  • Just Kampers Hire shall hold the Liability Deposit in a third-party account.
  • Just Kampers Hire shall refund the Liability Deposit, or any balance thereof within 7 days of:
    • receiving notification from the Owner and Customer that any dispute or Additional Costs have been settled in full; or
    • the end of the Rental Period (in the case of no Additional Costs being incurred and no dispute arising between the Owner and the Customer).
  • The Owner may request to deduct from the Liability Deposit the Additional Costs and recover the balance between the Liability Deposit and the Additional Costs from the Customer, when this is not sufficient to cover the total value due. The balance shall be invoiced to the Customer and payable within 14 days of issue.
  1. Just Kampers Hire’s Insurance
  • Where the Owner’s Insurance is not provided, Just Kampers Hire shall provide insurance which complies with the provisions of clauses 1 to 12.5.
  • Where Just Kampers Hire’s Insurance is provided the Customer may be subject to further Verification including a credit check. The Customer must promptly provide to Just Kampers Hire all necessary information required by Just Kampers Hire’s Insurer and the Customer warrants that such information will be accurate and true.
  • The cost for Just Kampers Hire’s Insurance may be subject to change from the time of Booking to the time the Total Price is due. Any change in price would only result from a change in the Customer’s or Driver’s circumstances. .
  • Just Kampers Hire shall provide a copy of the Just Kampers Hire’s Insurance policy to the Customer or Driver on or before the Departure Date. The Customer shall review and comply with all terms of the Just Kampers Hire’s Insurance.
  • A copy of the Just Kampers Hire’s Insurance policy and receipt of payment of the premium shall be provided to the Owner upon request.
  • The Customer must not carry out any act, omission or allow any act or omission to be carried out during the Rental Period that may invalidate or void Just Kampers Hire’s Insurance. If the Customer does not comply with this clause 6 or provide inaccurate or untrue information in compliance with clause 15.1, any risk that would have been otherwise insurable under Just Kampers Hire’s Insurance shall be at the cost of the Customer.
  1. Breakdown or Accident Procedure
  • In the event of a Breakdown or if the Rental sustains any Damage, is involved in an accident or collision, the Customer must contact the emergency services (if required) in the first instance, and Just Kampers Hire and the Owner as soon as possible thereafter.
  • The Customer and Driver must act in accordance with all applicable laws, including applicable foreign laws if the incident takes place in a different country.
  • The Owner or Just Kampers Hire may instruct the Customer to contact the Owner’s Insurer or Just Kampers Hire’s Insurer (as applicable) or the Breakdown Provider directly and the Customer must follow the instructions of the respective Insurer or Breakdown Provider and comply with the terms of the respective policies.
  • The Customer must take photographic images of the Damage, the location, any damage to property or a third-party vehicle once safe to do so. The Customer must also use reasonable endeavours to obtain: the details of any other vehicle involved in an accident, the contact details of the drivers and contact details of any potential witnesses.
  • The Customer must complete the claim form and submit it together with any photographic evidence through the Website or to Just Kampers Hire by e-mail: [email protected]
  • The Customer must not repair any Damage or defect without the prior written consent of either the Owner, Just Kampers Hire and/or the respective Insurer.
  • The Customer must provide on-going assistance to the Owner or Just Kampers Hire in relation to any insurance claim.
  • The Repair Costs or losses incurred by any Damage or defect caused by the Customer or Driver that is excluded under the Owner’s or Just Kampers Hire’s Insurance or Breakdown policy shall be recovered from the Customer.

In the event of breakdown, if the breakdown is through no fault of the customer and the vehicle has been driven and cared for properly, they may be entitled to the following:

  • If the vehicle can be repaired within 5 hours, they are not entitled to any refund or any compensation.
  • If the vehicle takes more than 5 hours to repair then you must refund the cost of each day’s hire for which they are unable to continue with their trip. They are not entitled to any further compensation.
  1. Returning the Rental
  • The Customer must return the Rental at the time, date and location set out in the Booking Summary. The Rental must be returned in the condition and cleanliness as described in the Inventory with a full fuel level.
  • The Rental Period may be extended by mutual agreement between the Customer and the Owner subject to agreement by Just Kampers Hire where Just Kampers Hire’s Insurance is provided. Any extension under this clause 2 is subject to charges payable by the Customer calculated on a pro-rata basis in accordance with the length of the extension of the Rental Period and must be submitted through the Website.
  • 17.3 If the Customer does not return the Rental in accordance with clause 17.1 and is not subject to an extension agreed pursuant to clause 17.2, a rate of £75 for every 1 hour that the Rental is overdue may be charged to the Customer.
  • The Late Charge shall be divided between the Owner and Just Kampers Hire as set out below:
    • 90 percent of the Late Charge shall be paid to the Owner within 7 working days of Just Kampers Hire receiving payment of the Late Charge from the Customer; and
    • 10 percent of the Late Charge shall be retained by Just Kampers Hire.
  • Any Damage or defects caused to the Rental must be reported by the Customer to the Owner and Just Kampers Hire as soon as possible upon occurrence and the Customer must comply with the procedures set out in clause 15.
  • If there is any Damage or defects not recorded in the Inventory or reported in accordance with clause 5, or a substantial discrepancy between the condition and cleanliness of the Rental recorded in the Inventory and the state of the Rental upon return after the Rental Period, the Owner must report and take photographic evidence of the Rental to substantiate the discrepancy. The report and images must be submitted to Just Kampers Hire through the Website in the first instance, or alternatively by email to: [email protected] within 1 hour of the Customer returning the Rental at the end of the Rental Period. In the case of any hidden defects not reasonably visible upon the Owner’s initial inspection of the Rental, must be reported to the Customer and Just Kampers Hire at the earliest possible opportunity but no later than 12 hours from the time the Rental has been returned by the Customer.
  • The Customer must immediately return the Rental upon request of the Owner if the Rental has been used in breach of the Rental Agreement and the Customer shall not be entitled to any refund of the Total Price where this is before the end of the Rental Period.
  • If the Customer does not return the Rental according to the terms of the Rental Agreement, Just Kampers Hire will support the Owner to call the police and all evidence in Just Kampers Hire’s possession will be transferred to the police.
  1. Permitted use of the Rental and Customer’s Liability
  • The Customer shall be responsible for all the goods and persons transported in the Rental.
  • The Customer must not:
  • use the Rental for any unlawful, illegal or immoral purpose or in anyway that may bring the Owner’s or Just Kampers Hire’s reputation into disrepute;
  • use the Rental in any way that contravenes the Owner’s vehicle instructions or the Rental’s user manual;
  • commit any traffic violations;
  • use the Rental beyond the maximum capacity set out in the Listing or as notified by the Owner;
  • drive the Rental above the maximum limit permitted by law or which the Rental may be restricted to;
  • travel with the Rental to countries, parts of countries or states other than the ones permitted by the Owner and the Owner’s Insurance or Just Kampers Hire’s Insurance (as applicable);
  • use the Rental in violation of any the house rules set out in the Booking Summary or Listing;
  • sublet the Rental (rent out the Rental to any third parties);
  • ignore the Rental’s warning lights or signals;
  • change travel companions without the prior written consent of the Owner;
  • sell the Rental or pass the Rental off as the Customer’s property;
  • use or drive the Rental recklessly or negligently;
  • allow others to use or drive the vehicle (other than the Customer or the Driver); or
  • use the Rental for any commercial purpose without prior written agreement from the Owner and Just Kampers Hire.
  • The Customer must ensure that the Driver is aware of the Rental Agreement and complies with the same.
  • The Customer shall cover the cost of any Excess payable due to any Damage or other act or occurrence caused by the Customer or Driver resulting in an insurance claim on the Owner’s Insurance or Just Kampers Hire’s Insurance (as applicable). The Customer will in addition be charged for the reasonable administrative costs of the Owner and/or Just Kampers Hire for time spent handling an insurance claim.
  • The repair costs resulting from the Customer putting the improper substances in the fuel tank, gas tank, clean water tank and/or waste water tank shall be at the Customer’s expense and payable within 14 days of issuing an invoice.
  • The Customer is liable for any costs related to any violations and/or the use of toll roads during the Rental Period. This Customer’s liability under this clause 6 shall continue beyond termination or expiry of the Rental Agreement.
  • The Customer must not carry out any act, omission or allow any act or omission to be carried out during the Rental Period that may invalidate or void the Owner’s Insurance. If the Customer does not comply with this clause 7, any risk that would have been otherwise insurable under the Owner’s Insurance shall be at the cost of the Customer.
  • The Customer shall indemnify (guarantee to compensate) all liabilities, costs, expenses, damages and losses (including any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs and all other reasonable professional costs and expenses) suffered or incurred by the Owner or Just Kampers Hire arising out of or in connection with any material breach of the Rental Agreement.

Appendix A.

Requirements for Rental Servicing

  1. The Owner must ensure that the following maintenance is carried out in relation to the Rental:
  • Vehicle construction:
    • Inspection of the Rental’s sealant and seams;
    • Lubrication of the cylinder locks of shutters and doors;
    • Inspection of the Rental’s bottom plate, gas hose and pressure regulator;
    • Pressure testing the gas system;
    • Testing the battery with the appropriate measuring equipment; and
    • Perform moisture measurement.
  • Vehicle, chassis and engine:
    • Regular replacement of the oil and oil filter;
    • Keeping the windscreen washer fluid at an appropriate level;
    • Checking coolant, measuring and topping up antifreeze;
    • Visual inspection of lighting;
    • Checking and correcting tyre pressure and inspection of the tyres (including but not limited to: profile, condition, age);
    • Testing the starter battery with measuring equipment and testing the brake fluid;
    • Visual inspection of the chassis, engine and brakes;
    • Inspection and maintenance of a gas safety certificate carried out every year by a Gas Safe Registered engineer for all fixed LPG gas appliances.

This list is non-exhaustive and must be carried out in addition to legal and health and safety requirements.

Your Account shall be suspended and you will be charged up to £500 to cover Rebooking Costs and / or loss of expenses already incurred by the Customer (e.g. ferry crossings or campsite fees).

You shall receive 100% of the Rent (agreed commission amount deducted) and you shall not be entitled to any further compensation.
